By booking or participating in a paint party event with Artistry of Jessica Cruz("we," "us," "our"), you ("Client" ,"Host", "Participant") agree to the following terms and conditions. It is your responsibility to read and understand these policies fully before booking.
Booking and Prepayment Terms
Prepayment Required: All events must be prepaid 3 business days before the scheduled date. Payment secures your reservation.
Minimum Guests: The minimum cost for an event is $175, regardless of the number of attendees, with a minimum group size of 5 participants, booked in increments of 5.
No Refunds: We maintain a strict no refund policy for any guests who do not attend. The prepaid amount will not be refunded or applied to future events.
Rescheduling: Events may be rescheduled once with at least 72 hours' notice. Failure to provide adequate notice will result in forfeiture of the booking fee.
Cancellation by Artist: If we must cancel the event, we will offer either a full refund or the option to reschedule at no additional cost.
Event Details
The date, time, and location of the event will be agreed upon at booking. The Client/Host is responsible for ensuring that the event location is appropriate, including providing adequate space, lighting, tables, and chairs (unless otherwise arranged).
Supplies and Ownership
Artist-Provided Supplies: We provide all painting materials, including canvases, paints, brushes, and other necessary tools. All supplies remain the property of Artistry of Jessica Cruz and will be collected at the end of the event.
No-Show Guests: If reserved guests do not attend, we retain all supplies allocated for them.
Instruction Only Fee's
Artist's Fee
The Artist will be compensated with a fixed fee for providing instruction. This amount is payable in full the day of the event, before the workshop begins.
Client/Host-Provided Supplies: If you choose to provide your own painting supplies, we are not responsible for the quality or adequacy of those materials.
Payment and Pricing
The event rate is $35.00 per participant plus applicable taxes, with a minimum of 5 guests, spend of $175.
A non-refundable deposit $75.00 is required to confirm your booking. The remaining balance is due on the day of the event, before setup begins.
No Refund Policy
Once supplies are purchased for the number of participants reserved, no refunds will be issued. If any guests fail to attend, no portion of the payment will be refunded, and the Artist retains the supplies for those participants.
Liability
We are not liable for any injuries, accidents, or damages that occur during the event. The Client/Host is responsible for the conduct and safety of all guests.
Alcohol Consumption:
If alcohol is consumed at the event, we are not responsible for any resulting damages, injuries, or incidents.
Cancellations and Rescheduling
Client Cancellations: Deposits are non-refundable. If you provide at least 7 days' notice, rescheduling may be allowed at our discretion. If less than 7 days' notice is given, the event cannot be rescheduled, and the deposit will be forfeited.
Privacy Policy
Data Collection: We collect personal information (name, contact details, payment information) solely for processing reservations and facilitating events.
Data Security: We protect your information and do not share it with third parties, except as necessary for payment processing or as required by law.
Force Majeure
We are not responsible for delays or cancellations due to events beyond our control, including natural disasters, government restrictions, or unforeseen circumstances.
Governing Law
These Terms and Policies are governed by the laws of the State of California, and any disputes will be resolved in Riverside.
By booking an event with Artistry of Jessica Cruz, you acknowledge that you have read, understood, and agree to these Terms and Policies.
Intellectual Property
Ownership of Content: All intellectual property related to the paint party, including original art designs, methods, and instructional content created during the event, is the sole property of Artistry of Jessica Cruz.
Restrictions on Use: Customers may not copy, distribute, reproduce, or use our intellectual property without prior written consent.
Participant Artwork: Participants retain ownership of the artwork they create during the paint party. However, by attending the event, participants grant Artistry of Jessica Cruz a non-exclusive, royalty-free license to use photographs of their artwork for promotional purposes unless expressly prohibited by the participant.
Agreement to Terms
By booking or attending an event, participants agree to these terms and conditions. We reserve the right to update or modify these terms at any time, and continued participation in events constitutes acceptance of any such changes.
Third-Party Website and Content
Our website may include links to third-party websites. Artistry of Jessica Cruz is not responsible for the content, accuracy, or opinions expressed in such third-party websites. Use of third-party websites is at your own risk.
Payment Processing: Payments for services are processed via third-party platforms. Artistry of Jessica Cruz is not liable for any issues related to payment processing, data breaches, or errors occurring on these platforms.
User Representations
- By booking or attending an event, you represent that:
- You are at least 18 years old.
- You have the legal capacity to agree to these terms and conditions.
- You will comply with all local, state, and federal laws in relation to your participation.
Prohibited Conduct: Participants may not engage in behavior that is unlawful, harmful, or disruptive during the paint party. Artistry of Jessica Cruz reserves the right to remove participants for inappropriate behavior without refund.
Site Management
We reserve the right to monitor and manage any content related to our website, social media, or other digital platforms. Any inappropriate content will be removed at our discretion.
Indemnification
Customers agree to indemnify, defend, and hold harmless Artistry of Jessica Cruz, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising from their participation in a paint party, including but not limited to injuries, loss of personal belongings, or property damage.
Corrections/Errors
We strive for accuracy in all our communications and content. However, Artistry of Jessica Cruz reserves the right to correct any typographical errors, inaccuracies, or omissions, and to update information at any time without prior notice.
Dispute Resolution
Good Faith Negotiations:In the event of a dispute, parties agree to first attempt resolution through informal discussions in good faith.
Mediation/Arbitration: If the dispute cannot be resolved, the parties agree to mediate the issue in Riverside County, California, before a neutral mediator. If mediation fails, the parties may seek resolution through arbitration or court as applicable.
Limitation of Liability: Artistry of Jessica Cruz is not liable for any incidental, consequential, or indirect damages related to its services.
